Terms & Conditions

By “Opting In” (as defined below), you accept these Terms and Conditions and agree to resolve disputes with Master Bill's Karate through binding arbitration (with very limited exceptions) and waive your right to participate in class actions, as detailed in the “Disputes” sections below.

Definitions:

  • “Emails” refer to one or more emails sent to your email address for various purposes, including informational, transactional, marketing, promotional, or sales purposes.

  • “Opting In,” “Opt In,” and “Opt-In” (or similar words or phrases) refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive one or more recurring text messages (and participation in a Text Message Service), Outbound Telephone Calls, and Emails.

  • “Master Bill's Karate” refers to Master Bill's Karate, its subsidiaries, and affiliates.

  • “Outbound Telephone Calls” are one or more telephone calls to your telephone number, including your wireless phone number, to induce the purchase of goods or services.

  • “Services” encompass Emails, Outbound Telephone Calls, and the Text Message Service.

  • “Text Message Service” refers to any arrangement where Master Bill's Karate sends or indicates that it may send one or more text messages, including recurring text messages.

Opting In:

By Opting In to any Text Message Service:

  • You authorize Master Bill's Karate to use auto-dialer or non-auto-dialer technology to send text messages to the mobile phone number you provided with your Opt In. You also authorize Master Bill's Karate to include marketing content in such messages.

  • You are signing your Opt In for the Text Message Service.

  • You confirm you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and are authorized to Opt In.

  • Supported carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular, Cellular One, MetroPCS, ACS/Alaska, Bluegrass Cellular, Cellular One of East Central Illinois, Centennial Wireless, Cox Communications, EKN/Appalachian Wireless, GCI, Illinois Valley Cellular, Immix/Keystone Wireless, Inland Cellular, Nex-Tech Wireless, Rural Cellular Corporation, Thumb Cellular, United Wireless, West Central (WCC), Cellcom, Cellsouth, Cricket, Cincinnati Bell, and Virgin Mobile. Master Bill's Karate and the mobile carriers (including T-Mobile®) are not liable for delayed or undelivered messages. Please note that supported mobile carriers may change without notice, and the specific Text Message Service you join may be limited to certain carriers.

By Opting In to receive Outbound Telephone Calls:

  • You authorize Master Bill's Karate to use auto-dialers and/or general telemarketing practices to call the telephone number, including your wireless phone number, you provided with your Opt In. You also authorize Master Bill's Karate to call you regarding transactional, informational, marketing, promotional, or sales-related matters.

  • You are signing your Opt In to receive Outbound Telephone Calls.

  • You confirm you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and are authorized to Opt In.

By Opting In to receive Emails:

  • You authorize Master Bill's Karate to send Emails to your email address. You also authorize Master Bill's Karate to send marketing, promotional, and sale-related Emails.

  • You are signing your Opt In to receive Emails.

  • You confirm you are the owner of the email account and address or that you are the customary and authorized user of such email account and address.

Opting In for any of the Services is not a condition for the purchase of any products or services. Furthermore, in connection with all Services, you consent to the use of an electronic record to document your Opt In. To withdraw this consent, request a free paper or email of the Opt In, or update your contact information in our records, please email info@masterbillskarate.com. To view and retain an electronic copy of these Terms and Conditions, you will need (i) a device with internet access, such as a computer or mobile phone, and (ii) a printer or storage space on your device. These Terms and Conditions will still apply if you withdraw the consent mentioned above or opt out of any of the Services.

About the Services and Opting Out:

Emails – Master Bill's Karate reserves the right to terminate Emails at any time, with or without notice. However, these Terms and Conditions will still apply. To opt out of or unsubscribe from Emails, please click the “unsubscribe” link or a similar link on the bottom of an Email. Your request to opt out may generate either a confirmation or a request for clarification regarding the Emails to which your request applies. In some cases, you may not be able to opt out of transactional-related Emails.

Outbound Telephone Calls – Master Bill's Karate reserves the right to terminate Outbound Telephone Calls at any time, with or without notice. These Terms and Conditions will still apply. To opt out or revoke your consent to receiving Outbound Telephone Calls, please email info@masterbillskarate.com or, if you are on the phone with a Master Bill's Karate representative, notify the representative that you wish to opt out or revoke your consent.

Text Message Service – Master Bill's Karate reserves the right to terminate any Text Message Service or your participation in it at any time, with or without notice. However, these Terms and Conditions will still apply. Message and data rates may apply. Unless otherwise noted, the Text Message Service sends automated multiple, recurring messages. For any Text Message Service, you can get help by texting HELP in response to a text and opt out by texting STOP in response to a text. Your opt-out request may generate either a confirmation text or a text request for clarification regarding the Text Message Service to which it applies.

Disputes:

Any dispute or claim arising out of or relating to the Services will be resolved through binding arbitration, rather than in court, with limited exceptions, except when your claims qualify for small claims court. The Federal Arbitration Act and federal arbitration law apply to these Terms and Conditions.

By agreeing to arbitration, you understand and agree that you are waiving your right to pursue other available resolution processes, such as court action or administrative proceedings, to settle any disputes or claims. Arbitration operates differently from court proceedings. There is no judge or jury, and while the review is limited, an arbitrator can award, on an individual basis, the same damages and relief available in court and must enforce the same limitations outlined in these Terms and Conditions.

To initiate arbitration, send a demand to the American Arbitration Association (AAA) describing your claim and notify us at Master Bill's Karate, Attn: Legal Department, 4650 W Walton Blvd, Waterford Twp, MI 48329. The arbitration will be conducted by the AAA under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The rules and the form for filing an arbitration claim are available at www.adr.org or by calling 1-800-778-7879. Payment of filing, administration, and arbitrator fees will follow the AAA's rules. We will reimburse these fees (but not attorney's fees) for claims totaling less than $10,000 unless the arbitrator finds your claims frivolous. You can opt for arbitration to be conducted by telephone, based on written submissions, or in person at your location or another mutually agreed-upon location.

We both agree that any dispute resolution proceedings of any nature or forum will only be conducted on an individual basis and not as part of a class, consolidated, or representative action. You may not represent a class or any other person, and an arbitrator may not consolidate claims or preside over any form of a representative or class proceeding.

If for any reason a claim proceeds in court rather than in arbitration, we both waive our right to a jury trial unless such a waiver is unenforceable under applicable law.

Applicable Law:

The Federal Arbitration Act and federal law govern these Terms and Conditions, with the absence of applicable federal law, the laws of the state of Michigan. These laws apply to any disputes or claims against Master Bill's Karate arising from or relating to any of the Services.
